AFFILIATE PARTNER AGREEMENT

McClintock Wellness LLC


I. Acceptance Into the Program

After submitting the affiliate application, the Company will review your information.If accepted, you will receive an approval email containing your unique affiliate link, discount code, commission rate, and onboarding instructions.If additional information is needed, the Company will contact you directly.Submitting an application does not guarantee acceptance.

III. McClintock Wellness Affiliate Partnership Agreement

This Affiliate Partnership Agreement ("Agreement") is entered into between McClintock Wellness LLC (“Company”) and the undersigned Affiliate (“Affiliate”).By electronically signing, Affiliate agrees to the following:


1. Term & Termination

This Agreement begins upon acceptance and continues until terminated.Either party may terminate at any time with written notice.Upon termination:

  • Affiliate link and discount code will be disabled

  • Eligible commissions will be paid

  • No new commissions will accrue

2. Commission Structure

Commissions apply only to qualifying sales generated through your unique tracking link or discount code:

  • Digital Courses: 10%

  • Supplements & Wellness Products: 5%

  • Merch/Apparel: 10%

Commissions do not apply to:

  • Returned/refunded orders

  • Cancelled orders

  • Fraudulent orders

  • Gift cards

  • Wholesale or bulk orders

  • Employee/insider purchases

  • Bundles or excluded product categories

3. Tracking & Attribution

  • Tracking is based on your unique link or code

  • Sales cannot be credited retroactively

  • Cookies last 30 days unless otherwise noted

4. Payment Terms

  • Paid monthly on completed (non-refunded) sales

  • Affiliate must provide accurate payment & tax info

  • Payments may be paused for suspected fraud

5. Promotion Expectations

Affiliate agrees to:

  • Promote honestly and responsibly

  • Follow all FTC disclosure guidelines

  • Avoid medical/disease claims

  • Maintain brand integrity

Affiliate may not:

  • Imply employment or representation of McClintock Wellness

  • Misrepresent product capabilities

  • Run PPC ads using our brand terms

  • Use confusing or copycat domains/handles

  • Use unapproved coupon codes

  • Engage in spam, misleading tactics, fake reviews, etc.

6. Content Ownership & Usage Rights

Affiliate retains ownership of their content.The Company may not repurpose affiliate content (ads, email, website, course, print, etc.) without:

  • Written permission

  • A separate licensing agreement

  • Additional compensation

7. PPC, Search & Advertising Restrictions

Not Allowed:

  • PPC ads bidding on “McClintock,” “McClintock Wellness,” or brand variations

  • Using brand terms in ad titles, descriptions, URLs

  • Direct-linking paid ads to our website

  • Google Shopping or CSS ads on brand terms

  • Misspellings of our name

Allowed:

  • Organic content (posts, videos, blogs, etc.)

  • SEO content (non-brand primary keywords)

  • Paid ads promoting your own content

8. Prohibited Activity

Affiliate may not engage in:

  • Cookie stuffing

  • Adware / malware / spyware

  • Browser extensions / coupon injectors

  • Fake reviews

  • Deceptive marketing practices

Violations may result in immediate removal and forfeiture of commissions.


9. Modification of Terms

Company may update terms with 7 days’ notice.Continued participation indicates acceptance.


10. Liability Limitation

  • Company is not liable for indirect, incidental, or consequential damages

  • Maximum liability is limited to commissions paid in the last 12 months

11. Indemnification

Affiliate agrees to indemnify the Company against claims arising from:

  • Promotional activity

  • FTC violations

  • Misrepresentations

  • IP violations

  • Breach of this Agreement

12. Severability

If any provision is invalid, the remainder of the Agreement remains enforceable.


13. Governing Law & Dispute Resolution

  • Governed by Florida law

  • Disputes resolved via binding arbitration in Florida

  • Both parties waive the right to a jury trial

14. Entire Agreement

This Agreement constitutes the full understanding between both parties.
